Gov. Robert Bentley‘s legal adviser has responded to a subpoena for documents ahead of the ethics trial of indicted House Speaker Mike Hubbard.
Al.com reports David Byrne appeared in Lee County Circuit Court on Friday to give documents to Judge Jacob Walker III. The subpoena requested documents on Attorney General Luther Strange appointing Acting Attorney General Van Davis to investigate Hubbard.
The Auburn Republican faces 23 felony ethics charges accusing him of using his political offices for personal financial gain.
Hubbard’s legal team has argued that only Bentley can appoint an acting attorney general, but Walker rejected a similar claim in another state lawmaker’s perjury trial. Hubbard’s trial is set for October, and Bentley is not expected to testify at a pretrial hearing set for Wednesday.
