Barry Moore joins lawsuit to end mask mandate for air travel

Representative Barry Moore has joined sixteen of his colleagues in a lawsuit against the Centers for Disease Control and Prevention (CDC). The lawsuit, Massie et al v. Centers for Disease Control and Prevention, seeks to end the CDC’s mask mandate for individuals traveling on commercial airlines. Reports indicate the Biden Administration is extending the CDC’s mask mandate until April 18. Massie et al. v. Centers for Disease Control and Prevention was filed in the United States District Court for the Western District of Kentucky. The named defendants are Centers for Disease Control and Prevention, Rochelle P. Walensky in her official capacity as Director of the CDC, and Sherri A. Berger in her official capacity as Chief of Staff of the CDC.  The lawsuit contains two primary claims:  First, none of the statutes or regulations cited by the CDC for the authority to mandate that individuals wear masks on commercial airlines, conveyances, and at transportation hubs, permit the CDC to implement or enforce this mandate.  Second, even if Congress had granted the CDC the authority to promulgate the mask mandate, the granting of this authority would violate a principle known as the “non-delegation doctrine.” Moore and his co-plaintiffs are asking a federal court to declare that “the mask mandate is beyond the CDC’s statutory authority or is unconstitutional.” The plaintiffs are also seeking an injunction that prohibits the CDC, or anyone acting on the CDC’s behalf, from enforcing the mask mandate.  Rep. Thomas Massie argued that the CDC doesn’t have the authority to force people to wear masks on airplanes because Congress never passed a law requiring it. “The Centers for Disease Control and Prevention does not have the legal authority to force people traveling on commercial airlines to wear masks,” stated Massie. “Congress never passed a law requiring masks on commercial flights. This lawsuit targets the faceless bureaucrats who are behind the CDC’s unscientific regulation so that this illegal mask mandate can be brought to a permanent end.” Moore argued that the mandate should end immediately because it infringes on constitutional freedoms. “Government bureaucrats desperate for relevancy are waging a war against everyday American citizens and their constitutional freedoms,” stated Rep. Moore. “The unscientific mask mandate for commercial air travel should be ended immediately, and I am proud to join my friend Rep. Massie in this lawsuit to end this charade permanently.” Additional plaintiffs for the lawsuit include Reps. Mo Brooks introduces the Freedom to Fly Maskless Act

Congressman Mo Brooks has introduced a bill to prohibit the federal government from mandating masks, negative COVID-19 tests, and vaccinations on public transportation, including domestic flights. The Freedom to Fly Maskless Act aims to “limit the authority of the Department of Health and Human Services to regulate interstate commerce relating to communicable diseases, to amend title 49, United States Code, to limit the authority of the Federal Aviation Administration to regulate air commerce relating to communicable diseases.” In December, Southwest Airlines CEO Gary Kelly told the U.S. Senate Commerce, Science and Transportation Committee: “The statistics I recall is that 99.97% of airborne pathogens are captured by the [high efficiency particulate air] filtering system, and it’s turned over every two or three minutes. I think the case is very strong that masks don’t add much, if anything, in the air cabin environment. It’s very safe, and very high quality compared to any other indoor setting.” Original cosponsors include Reps. Paul Gosar, (AZ), Jeff Duncan (SC), Bob Gibbs (OH), Scott Perry (PA), Brian Mast (FL), Brian Babin (TX), Thomas Tiffany (WI), Mary Miller (IL), and Byron Donalds (FL). Brooks stated, “The American people are sick and tired of being dictated to by unelected Washington bureaucrats. As we have seen throughout the pandemic, the Department of Health and Human Services (HHS) has worked with other entities like the Transportation Security Administration (TSA) to impose masks, testing, and vaccination requirements. Unelected bureaucrats have falsely claimed the power to foist unnecessary and anti-science mandates on the American people. These mandates have resulted in good Americans being fired from their jobs, being jabbed with needles against their will, and even losing their businesses in some cases. It is time to throw off the heavy boot of tyranny that’s crushing the American spirit. Washington bureaucrats need reminding that America was founded on freedom and liberty.”  Brooks concluded, “My bill, the ‘Freedom to Fly Maskless Act’ would prohibit unelected Washington bureaucrats from requiring masks, tests, and vaccinations on public transportation, including domestic flights. Each individual has the right to decide what health precautions they want to take when confronting Communist China’s lab-created virus or any future illness. Let me be clear, there is no amount of mandates and dictates that will end the COVID-19 pandemic. COVID-19 will continue to spread. Americans must learn to live with this virus because it’s going to be with us long-term. Continued mandates are not justified, and it’s long past time Americans return to our pre-pandemic lives.”

Reps. Barry Moore and Mo Brooks demand DOD halt involuntary discharges for vaccine refusal immediately

Reps. Barry Moore and Mo Brooks joined 40 of their colleagues in sending a letter to the Department of Defense (DOD) to demand that they halt efforts to involuntarily discharge members of the military who have refused COVID-19 vaccination. The letter requests that they stop until an in-depth review of natural immunity is complete, and the Department has issued uniform procedures for vaccine exemptions. According to Moore’s press release, Section 720 of the National Defense Authorization Act for Fiscal Year 2022 requires the DOD to establish uniform procedures for issuing exemptions and fully consider natural immunity. This includes eligibility timelines for consideration of exemptions for service members nearing separation and retirement in the development of uniform procedures relating to administrative exemptions. According to an NPR report, as of January 26, 96% of active troops had been completely vaccinated, while 3,350 soldiers had refused to get the vaccine. Nearly 5,900 have received temporary exemptions. “The DOD must immediately halt efforts to discharge our active-duty military members who refuse to get the vaccine just because overreaching politicians want to continue intervening in the private lives of the American people,” said Moore. “We must ensure that the DOD completes an in-depth review of natural immunity. I will continue to fight against the tyrannical vaccine mandate on our service members.” The letter states, “We are gravely concerned that the military services are proceeding with involuntary discharges when it is unclear to us whether uniform procedures have been issued by the Department of Defense. If the Department of Defense has not issued uniform procedures or reviewed the inclusion of natural immunity and the military services are moving forward with involuntary discharges, then we believe the Department is ignoring and violating Section 720. Congressmen call for the reopening of the U.S. Capitol

Today, Congressmen Robert Aderholt, Jerry Carl, Mo Brooks, and Barry Moore joined more than two dozen other leaders, asking Speaker Nancy Pelosi and Senate Majority Leader Chuck Schumer to reopen the United States Capitol Complex to visitors. The Capitol has been closed since the January 6 attack by a mob of pro-Trump protestors. In March 2020, the U.S. Capitol had restricted access because of COVID-19 concerns. As more and more people become vaccinated, the push to reopen has been becoming louder. However, there are still security concerns.  Brooks stated, “The First Amendment to the Constitution establishes the people’s right to petition their government for redress of their grievances. Prior to Pelosi and Schumer’s draconian Capitol access restrictions, the American people could easily visit the Capitol offices of their senators and representatives. Now, to gain access to the House and Senate office buildings, citizens must be on preapproved lists kept by the House and Senate Sergeant at Arms.” He continued, “America has historically prided ourselves on transparency and easy citizens access to government institutions.  It is shameful that Nancy Pelosi and Chuck Schumer persist in keeping the law-abiding American citizens out of their own Capitol, especially when states are lifting restrictions and the CDC is recommending fully-vaccinated Americans return to pre-COVID normalcy. Nancy Pelosi said ‘about 75%’ of House members are vaccinated. That exceeds herd immunity requirements.” Aderholt commented, “With the pandemic coming to an end, it is time to open the United States Capitol Complex to the citizens it belongs to. Roy Moore calls out the hypocrisy of Congressman Brian Mast who joked about underage sex and rape

Judge Roy Moore released a scathing statement today regarding South Florida Congressman Brian Mast.  Mast has admitted to posting inappropriate comments about rape and underage girls in 2009 and 2011. According to the SunSentinel, one of the comments happened on February 23, 2009. Mast commented on a picture posted by Rocco LeDonni, taken during a vacation in South Africa. Mast commented, “im so proud of you… i hope you hook up with at least fifteen 15 year olds over there…. its legel there right.” Two years later, LeDonni asked in a post, “Anyone have any good pick up lines for this weekend considering according to the crazy christian radio guy the world may end on sunday?” Mast responded, “How about don’t turn this rape into a murder.” LeDonni is now Mast’s campaign manager. Moore’s comment was posted by his wife, Kayla Moore, on her Facebook page. Roy Moore stated, “When “false and malicious” sexual allegations over 40 years old were made against me in a hotly contested Senate race in Alabama in 2017, Rep Brian Mast called upon me to drop out of the race without ever trying to find out the truth. Now by his own admission, he has joked about inappropriate sexual relationships with “15-year-olds.” Congress does not deserve such hypocrisy! Mast should drop out of the race by his own judgment lest he help elect another Democrat to Congress.” In a TCPalm story in 2017, Mast didn’t support Moore when he was accused of inappropriate sexual behavior towards five women when they were minors. Mast stated, “Pedophiles should have no place in the United States Congress.” With that statement, many other members of Congress expressed the same sentiment. At the time, Moore was running against Luther Strange. Others are also calling for Mast’s resignation, including former SEAL Team Six member Craig Sawyer and Roger Stone, a longtime Trump ally. Palm Beach County Commissioner Melissa McKinlay and Senator Lauren Book have also called for Mast to resign. Book remarked that Mast “demonstrated a complete lack of respect for women and questionable moral character unbecoming of a Congressman.”  After the SunSentinel article broke, Mast made a statement. “A decade ago when I was in the Army, and following my injury, I made disgusting and inappropriate jokes that I am embarrassed to have associated with my name today. I am sorry about that part of who I was, and I strive every day to be a better example for my kids.” On Saturday, protestors gathered outside of his office, demanding his resignation. Some protestors stated they accepted his apology but didn’t believe he should not represent them on Capitol Hill. Lucy Angelo-Walker, a protestor who spoke to WPTV, said, “He has a daughter (who) will be 15 one day, and I would hate to think that there was someone out there (who) was given advice like he gave to a friend who would then be a predator in the situation that his daughter is in.” Mast currently represents the district that includes northern Palm Beach County and the Treasure Coast. He has frequently voted in favor of Trump’s agenda in Congress. In 2016 he beat Randy Perkins, and in 2018 he defeated Lauren Baer with 54% of the vote. He is currently in a re-election battle with Democrat Pam Keith.   

New pro-Trump ads praise Gary Palmer for trying to repeal, replace Obamacare

An advocacy group formed by six of President Donald Trump‘s top campaign aides launched a $3 million advertising campaign to praise Congress members working to repeal and replace the Affordable Care Act. The list of 12 select members from America First Policies includes Alabama Republican Gary Palmer of Alabama’s 6th Congressional District.  “Obamacare is collapsing and bringing our health care system down with it, harming millions of American families,” said Nick Ayers, Chairman of the Board of America First Policies. “The time is now to repeal and replace this terrible law, but we need citizens to engage.” The issue advocacy campaign will be on broadcast or cable, the internet and through phone calls in twelve districts, including CD 18, which stretches from Ft. Pierce to Palm Beach in Southeast Florida. “We are also utilizing Trump voter data in partnership with the Data Trust to reach the same grassroots supporters that supported America First issues over the last two years,” said Brad Parscale, Senior Digital Advisor for America First Policies. “We will be utilizing Google and Facebook to connect with millions of targeted followers across twelve districts to ask them to contact their representative and encourage them to keep working to repeal Obamacare.” Many lawmakers were lobbied personally by Trump to support the GOP’s health care bill that never came up for a vote last month, and he reportedly called on his colleagues to unite behind the bill in an emotionally charged address, according to The Washington Post. One of those praised in the ads was in Florida’s 18th Congressional District, where Republican Brian Mast flipped the seat from blue to red last November when he defeated Democrat Randy Perkins. The seat had been held for the previous four years by Patrick Murphy, who opted to run for U.S. Senate last year. Announcing their creation in January, America First Policies officials said they would conduct research into public policies and promote Trump’s favored causes, such as changing immigration policies and dismantling and replacing the Affordable Health Care law. In their news release, America First Policies enclosed the ad specifically praising Palmer.
