Conservative lightning rod Roy Moore of Alabama, narrow loser of a turbulent special election for Senate in 2017, is considering a fresh run next year. National Republican leaders are signaling they’ll again try preventing their party from nominating the twice-removed state jurist whose campaign was battered by allegations of long-ago sexual harassment of teenagers. Moore’s defeat for the same seat two years ago made him the first Republican in reliably red Alabama to lose a Senate race in a quarter century. National party leaders say a Moore nomination would endanger what they view as a strong shot at defeating Sen. Doug Jones , the Democrat and former federal prosecutor who upset Moore two years ago. Moore’s nomination could also have national repercussions, allowing Democrats to accuse the GOP of ignoring the #MeToo movement and coddling a man accused of sexual misconduct , allegations he’s denied. Moore says he expects to announce a decision in mid-June. “I’m still praying about it and talking to people, my family, my wife and I’m strongly considering it,” Moore, 72, told The Associated Press on Wednesday. In a separate AP interview last week, he said 2020 “could be a touchpoint in our nation, not only for the presidency but for the House and Congress.” Moore said he had many reasons for considering another campaign but declined to elaborate. Republicans control the Senate 53-47 and view defeating Jones as a top priority. Jones, 65, is considered the most endangered Democratic incumbent facing re-election in 2020, a year when several GOP senators are vulnerable and control of the chamber will be at stake. Alabama’s deep conservative leanings were demonstrated anew this week with a new law criminalizing nearly every abortion in the state, which Jones called an “extreme” attack on women. With abortion potentially a driving 2020 issue and President Donald Trump certain to carry Alabama easily in next year’s elections, Republicans have little interest in fumbling a chance to recapture Jones’ seat. Establishment Republicans also have no taste for revisiting the chaos that was Moore’s 2017 Senate race. His campaign and his refusal to abandon it after the sexual harassment charges emerged a month before Election Day divided the party, with President Donald Trump giving Moore his eleventh-hour endorsement while other leaders remained opposed or distanced themselves from the contest. Jones defeated Moore by 22,000 votes out of 1.3 million cast. “The people of Alabama rejected Roy Moore not too long ago,” Sen. Todd Young, R-Ind., who leads the National Republican Senatorial Committee, the Senate GOP’s campaign arm, told the AP this week. “I with my Republican colleagues always want to be supportive of the most conservative candidate who can actually win a race, and I don’t see that anything has changed in the state of Alabama since the last election.” Asked if he would try to head off Moore, Young said, “We’ll actively work to make sure that the most conservative, electable Republican is our nominee.” Sending a similar signal was Senate Majority Leader Mitch McConnell, R-Ky., who tried unsuccessfully to derail Moore in 2017. Asked whether he’d oppose a renewed run by Moore, McConnell told a reporter, “I think you know the answer to that.” Alabama GOP leaders, who resisted pressure from Washington Republicans to hinder Moore’s path to the 2017 nomination, are showing no signs of thwarting him this time. “The voters will make these decisions,” state party Chairman Terry Lathan said in an email. She said she didn’t know Moore’s plans because “he rarely communicates with the Party.” McConnell’s and other party leaders’ preferred 2017 nominee was GOP Sen. Luther Strange, appointed months earlier to fill a vacancy. They feared that moderate voters would abandon Moore if he was nominated because of his hard-right views against gay marriage and for a larger role of religion in government, plus his use of racially insensitive language. The Senate Leadership Fund, a super PAC aligned with McConnell, spent $6.9 million in the primary against Moore and for Strange, according to Federal Election Commission figures. The Republican senatorial committee spent another $400,000 to help Strange. Moore defeated Strange in a runoff. McConnell began intervening in GOP primaries earlier this decade after some quirky contenders won nominations but lost winnable general elections. After winning the nomination, Moore’s campaign was further roiled when The Washington Post reported claims by several women that he pursued inappropriate relationships with them when they were teenagers and he was in his 30s. McConnell and others unsuccessfully called for Moore to step aside. Sen. Catherine Cortez Masto, D-Nev., who chairs the Democratic Senatorial Campaign Committee, parried a question about whether the sexual misconduct allegations would make Moore a weak candidate in 2020, saying, “You’ve already answered your own question.” Moore said Washington Republicans’ complaints that he couldn’t win another election were unfounded since he was elected twice as the state’s chief justice. He was removed both times, for publicly displaying the Ten Commandments and telling lower court judges to refuse to marry gay couples. “Should I qualify I’ll run for Senate in the state of Alabama, not Washington, D.C.,” said Moore, who’s been strongly supported by evangelical voters. Moore said he’s not reached out to Trump or White House officials this time. “It’s not because I’m adverse to President Trump at all,” he said. “I support his policies and what he stands for. I’m not running for anybody else, I’m running for the state of Alabama.” A White House spokesperson declined to answer questions. Trump presidential campaign aides didn’t immediately respond to emails seeking comment. Rep. Bradley Byrne, former Auburn University football coach Tommy Tuberville are among those who’ve already announced bids for the GOP nomination. Strange filled the vacancy left by Sen. Marco Rubio says next step in Syria is negotiating regime change

Sen. Marco Rubio says the next step in Syria should be to work with Sunni governments to discuss “an alternative” government in Syria. Rubio is a Florida Republican and onetime rival of President Donald Trump. The conservative tells NBC’s “Today” show that Trump should reach out to Saudi Arabia and the United Arab Emirates, as well as Turkey, to discuss ways to get Syrian President Bashar Assad to step down and create a new regime. Assad has not responded to diplomatic pressure in the past, but Rubio says the military strikes could change that. He says, “We need to now move forward through a combination of diplomacy and, quite frankly, the support of groups on ground, particularly non-jihadist Sunni groups, to create alternatives to the Assad regime.” Republished with permission of The Associated Press.

Congress seen as not likely to pass tax overhaul quickly

After their humiliating loss on health care, Republicans in Congress could use a quick victory on a big issue. It won’t be an overhaul of the tax code. Overhauling the tax code could prove harder to accomplish than repealing and replacing Barack Obama‘s health law. Congressional Republicans are divided on significant issues, especially a new tax on imports embraced by House Speaker Paul Ryan. And the White House is sending contradicting signals on the new tax, adding to the uncertainty. House Republicans also can’t decide whether to move on from health care. Ryan canceled a scheduled vote on a House GOP plan after it became obvious that Republicans didn’t have the votes. He said he will continue to work on the issue but one of his top lieutenants on health care, Rep. Kevin Brady, R-Texas, says he is now “100 percent” focused on a tax overhaul. Ryan says Congress can work on both at the same time. It won’t be easy. Here’s why: ___ REPUBLICAN DIVIDE House and Senate Republicans largely agree on the broad outlines of a tax overhaul. They want to lower tax rates for individuals and corporations, and make up the lost revenue by scaling back tax breaks. But they are sharply divided on a key tenet of the House Republican plan. The new “border adjustment tax” would be applied to profits from goods and services consumed in the U.S., whether they are domestically produced or imported. Exports would be exempt. House GOP leaders say the tax is key to lowering the top corporate income tax rate from 35 percent to 20 percent. But good luck finding a single Republican senator who will publicly support the tax. Sen. Rob Portman, R-Ohio, is the latest in a long line of Republican senators to come out against the tax. ___ ABSENT DEMOCRATS Senate Finance Committee Chairman Orrin Hatch, R-Utah, says he wants to work with Democrats to overhaul the tax code. “A bipartisan bill would allow us to put in place more lasting reforms and give the overall effort additional credibility,” Hatch said. Majority Leader Mitch McConnell, R-Ky., has said it is bad policy to pass major legislation without bipartisan support. “Without some meaningful buy-in, you guarantee a food fight,” McConnell wrote in his memoir last year. “You guarantee instability and strife.” But in the House, Republicans haven’t reached out to Democrats in any meaningful way. ___ WHERE’S THE WHITE HOUSE? “Obviously we’re driving the train on this,” White House press secretary Sean Spicer said. But President Donald Trump‘s administration has been all over the map on tax reform. Trump at one point said the House border tax is too complicated, then said it’s in the mix. Treasury Secretary Steven Mnuchin told a Senate panel that “there would be no absolute tax cut for the upper class” in Trump’s tax plan. However, the plan Trump unveiled during his presidential campaign would provide big tax breaks to high-income households. Since taking office, Trump has promised “massive” tax cuts for the middle class. A former Treasury official under President Barack Obama says the White House needs to stake out clear goals on tax overhaul to guide the debate in Congress. “I think it’s important for the administration to signal early the general shape” of what they would like to accomplish so that there are fewer proposals vying for attention, said Michael Mundaca, a former assistant Treasury secretary now at Ernst & Young. ___ TAX CHANGE IS DIFFICULT There is a reason it’s been 31 years since the last time Congress rewrote the tax code. Since then, the number of exemptions, deductions and credits has mushroomed. Taxpayers enjoyed $1.6 trillion in tax breaks in 2016 — more than the federal government collected in individual income taxes. That huge number could provide plenty of tax breaks that lawmakers can scale back so they can lower tax rates significantly. There is just one problem — all of the biggest tax breaks are very popular and have powerful constituencies. Nearly 34 million families claimed the mortgage interest deduction in 2016. That same year more than 43 million families took advantage of a deduction of state and local taxes. The House Republicans’ tax plan would retain the mortgage deduction and eliminate the deduction for state and local taxes. ___ HEALTH CARE Both Trump and Republicans in Congress made big campaign promises to repeal and replace Obama’s health law, so the issue won’t go away. However, several players say negotiations on a way forward are non-existent. In the meantime, Trump is stoking animosity among a key voting bloc by criticizing them on Twitter. Two factions in the House GOP had members oppose the health plan: the hard-right Freedom Caucus and the moderate Tuesday Group. Ryan has suggested that they get together to sort out their differences, but it’s not happening, according to one key lawmaker. “We are not currently negotiating with the Freedom Caucus. There was never a meeting scheduled with the Freedom Caucus. We will never meet with the Freedom Caucus,” said Rep. Chris Collins, R-N.Y., a member of the Tuesday Group. Trump tweeted: “The Freedom Caucus will hurt the entire Republican agenda if they don’t get on the team, & fast. House GOP health bill facing fresh House committee test

The White House and Republican leaders are talking to rank-and-file lawmakers about revising the GOP health care overhaul, hoping to keep a rebellion by conservatives and moderates from snowballing and imperiling the party’s showpiece legislation. Four days after a congressional report projected the bill would pry coverage from millions of voters, signs of fraying GOP support for the legislation were showing. The measure would strike down much of former President Barack Obama‘s 2010 overhaul and reduce the federal role, including financing, for health care consumers and is opposed uniformly by Democrats. In a fresh test of Republicans’ willingness to embrace the legislation, the House Budget Committee was considering the measure Thursday. Republicans expressed confidence the bill would be approved, but the vote could be tight. The panel can’t make significant changes but was expected to endorse non-binding, suggested changes to nail down votes. The bill would eliminate the tax penalty that pressures people to buy coverage and the federal subsidies that let millions afford it, replacing them with tax credits that are bigger for older people. It would cut Medicaid, repeal the law’s tax increases on higher earning Americans and require 30 percent higher premiums for consumers who let coverage lapse. Overt GOP opposition grew after the nonpartisan Congressional Budget Office projected Monday that the legislation would push 24 million Americans off coverage in a decade and shift out-of-pocket costs toward lower income, older people. Obama’s law has provided coverage to around 20 million additional people House Speaker Paul Ryan, R-Wis., told reporters Wednesday that leaders could now make “some necessary improvements and refinements” to the legislation. But he declined to commit to bringing the measure to the House floor next week, a schedule Republican leaders have repeatedly said they intended to keep. At a late rally in Nashville Wednesday, President Donald Trump said: “We’re going to arbitrate, we’re all going to get together, we’re going to get something done.” Vice President Mike Pence met with House GOP lawmakers and pressed them to unite behind the legislation. “‘It’s our job to get it out of here and get it to the Senate,’” Pence told Republicans, according to Rep. Dennis Ross, R-Fla. That would let Trump pressure “Democrats in these red states to come on board,’” Ross said, referring to Republican-leaning states where Democratic senators face re-election next year. But insurgents still abound. Conservatives want to end Obama’s expansion of Medicaid to 11 million additional low-income people next year, not 2020 as the bill proposes. They say a GOP proposed tax credit to help people pay medical costs is too generous, and they want to terminate all of Obama’s insurance requirements, including mandatory coverage of specified services like drug counseling. Rep. Mark Meadows, R-N.C., head of the hard-line conservative House Freedom Caucus, continued pushing for changes. He claimed at least 21 members of his group would oppose the measure as written; the bill would fail if 22 Republicans join all Democrats in opposing it. But underscoring the push-pull problem GOP leaders face in winning votes, moderates feel the tax credits are too stingy, especially for low earners and older people. They oppose accelerating the phase-out of the Medicaid expansion and are unhappy with long-term cuts the measure would inflict on the entire program. Terminating the Medicaid expansion in 2020 and not 2018 “is sacrosanct to me,” said moderate Rep. Tom MacArthur, R-N.J. In a new complication, Sen. Charles Grassley, R-Iowa, said the measure lacked the votes to pass in the Senate, where Republicans hold a precarious 52-48 majority. That left House members angry over being asked to take a politically risky vote for legislation likely to be altered. Moderates “don’t like the idea of taking a vote in the House that may go nowhere in the Senate,” said Rep. Charlie Dent, R-Pa. Amid the maneuvering, a federal report said more than 12 million people have signed up for coverage this year under the very statute that Republicans want to repeal. Dems force delays in votes on Jeff Sessions, Steve Mnuchin, Tom Price

Democrats forced delays Tuesday in planned Senate committee votes on President Donald Trump‘s picks for Health and Treasury secretaries and attorney general, amid growing Democratic surliness over the administration’s aggressive early moves against refugees and an expected bitter battle over filling the Supreme Court vacancy. Democrats abruptly boycotted a Senate Finance Committee meeting called to vote on Rep. Tom Price, R-Ga., the Health nominee and Steve Mnuchin, Trump’s Treasury selection, saying both had misled Congress about their financial backgrounds. The Democrats’ action prevented the Finance panel from acting because under committee rules, 13 of its members — including at least one Democrat — must be present for votes. It was unclear when the panel would reschedule to votes. At the Senate Judiciary Committee, a meeting considering Sen. Jeff Sessions, R-Ala., to be attorney general lasted so long — chiefly because of lengthy Democratic speeches — that Chairman Charles Grassley, R-Iowa, said the panel would meet again Wednesday. The meeting on Sessions’ nomination was coming with Democrats and demonstrators around the country in an uproar over Trump’s executive order temporarily blocking refugees. Even some Republicans were warning it could hinder anti-terrorism efforts. Not everything ground to a halt. The Senate education committee voted 12-11 to send Trump’s pick to head the Education Department, Betsy DeVos, to the full Senate for a confirmation vote. The Senate Energy and Natural Resources Committee quickly approved former Texas Gov. Rick Perry as Energy secretary by 16-7, and Rep. Ryan Zinke, R-Mont., to head Interior by 16-6. And the full Senate easily confirmed Elaine Chao to become transportation secretary by a 93-6 vote. Chao was labor secretary under President George W. Bush, and is wife of Senate Majority Leader Mitch McConnell, R-Ky. Just before the Finance committee was scheduled to vote on Price and Mnuchin, Democrats called a briefing for reporters and announced their plan to force a delay. Sen. Debbie Stabenow, D-Mich., said Price and Mnuchin would hold positions “that directly affect peoples’ lives every day. The truth matters.” Finance Committee Chairman Orrin Hatch, R-Utah, accused Democrats of “a lack of desire to fulfill their constitutional responsibilities.” “They ought to stop posturing and acting like idiots,” he said. In 2013 when Democrats controlled the Senate, Republicans boycotted a committee vote on Gina McCarthy to head the Environmental Protection Agency, temporarily stalling it. Democrats cited one report in The Wall Street Journal that Price received a special, discounted offer to buy stock in a biomedical company, which contradicted his testimony to Congress. They said another report in The Columbus Dispatch showed documents revealing that Mnuchin had not been truthful with the Senate in the confirmation process in comments about how his bank OneWest had handled home foreclosures. Republicans have supported both men, and both have strongly defended their actions. Democrats have opposed Price, a seven-term congressional veteran, for his staunch backing of his party’s drive to scuttle Obama’s health care law and to reshape Medicare and Medicaid, which help older and low-income people afford medical care. They’ve also assailed Price for buying stocks of health care firms, accusing him of using insider information and conflicts of interest for backing legislation that could help his investments. Price says his trades were largely managed by brokers and that he’s followed congressional ethics rules. Democrats have criticized Mnuchin for not initially revealing nearly $100 million in assets, and were expected to vote against both nominees. They’ve also accused him of failing to protect homeowners from foreclosures and criticized him for not initially disclosing all his assets. DeVos, a wealthy GOP donor and conservative activist, has long supported charter schools and allowing school choice. That’s prompted opposition from Democrats and teachers’ unions who view her stance as a threat to federal dollars that support public education. Critics have also mocked her for suggesting that guns could be justified in schools to protect students from grizzly bears. Two prominent Republicans on the education committee, Sens. Susan Collins of Maine and Lisa Murkowski of Alaska, said they remained uncertain if they will vote for her on the Senate floor. Tim Kaine says he’s not going to run for president in 2020

Virginia Sen. Tim Kaine says he’ll seek re-election in 2018 but is ruling out a presidential bid in 2020. The former Democratic vice presidential nominee said in an interview with The Associated Press on Thursday that his place is in the Senate and his decision not to run in 2020 is final. “Period. Full stop,” Kaine said. With a heightened national profile after campaigning across the country for more than three months as Hillary Clinton‘s running mate, Kaine could have chosen to pursue his own White House ambitions or tried and play a leading role charting a reeling Democratic Party’s direction in the Donald Trump era. But the first-term senator and former governor said he belongs in the upper chamber, where he will be part of a Democratic minority whose ability to filibuster will be “the only emergency brake there is” on Trump and the GOP-controlled Congress. Kaine has already been a vocal critic of Trump’s appointment of Steve Bannon as a senior advisor. Kaine said Bannon’s ties to white nationalism and anti-Semitism disqualify him from a senior role in the White House. Kaine said he would continue to guard against the “normalization” by Trump of what Kaine said were un-American values, but he added that he’s keeping an open mind about the billionaire businessman’s presidency. “I have a lot of concerns, but I don’t think it’s fair to the administration to just assume everything that was said during the campaign will be done,” Kaine said, noting that Trump had already shown some post-Election Day flexibility on issues like gay marriage and the Affordable Care Act. Kaine said there were some issues Democrats could work with Trump on, including increased infrastructure spending and raising the tax rate on carried interest, which is often used by managers for private equity firms and hedge funds to reduce tax payments. Kaine said he plans to use his higher national profile to continue to advocate for issues he’s long cared about, notably on increasing Congress’ role in war-making powers. “I’ve been willing to stand up and do that with a president of my own party and I tell you, I’m sure going to be willing to stand up to President Trump,” Kaine said. Kaine has twice come close to being vice president. He was on President Barack Obama‘s shortlist in 2008 and many expected Clinton to win this year. On the campaign trail this year, the deeply spiritual Kaine often told supporters that the election would work out the way things are supposed to. Kaine said Clinton’s loss was “hard” to take, but didn’t shake his faith that the outcome was for the best. “Maybe the whole reason I’m in the Senate was less being in the Senate when there was President Obama, who was a friend of mine. Hillary Clinton lining up policy priorities for 2017, if she wins

Hillary Clinton‘s advisers are crafting a domestic policy agenda for the opening months of a potential presidency that is centered on three issues with some level of Republican support: an infrastructure package that emphasizes job creation, criminal justice reform, and immigration legislation — with the promise of quick executive action if a bill fails in Congress. Clinton’s campaign aides and transition team have been emphasizing the trio of priorities in conversations with lawmakers and advocacy groups, according to several people involved in those discussions. While Clinton has spoken frequently about each subject in campaign appearances, her advisers’ discussions provide new insight into how the Democrat might approach her first months in the White House, should she defeat Donald Trump on Nov. 8. People with knowledge of Clinton’s planning insisted on anonymity because they were not authorized to discuss the private conversations publicly. Clinton campaign officials would not comment on the emerging agenda, saying Clinton is focused squarely on defeating Trump and helping Democrats take control of the Senate, which would improve her chances of securing passage of her policy priorities. “Anyone who thinks that our candidate or the campaign is focused on the transition is mistaken,” said Jennifer Palmieri, Clinton’s communications director. “Hillary Clinton is superstitious.” Clinton has led national and battleground state polls in recent weeks, though Trump sees a new FBI email inquiry as an opening to overtake the Democrat in the election’s closing days. If Clinton wins, immigration is expected be among the most complex domestic policy issues she hopes to tackle in 2017. Some Republican leaders, desperate to boost their party’s appeal with Hispanics, have backed legislation, but the party’s right wing keeps resisting, and may be more emboldened by the popularity of Trump’s hardline immigration policies with some GOP voters. Clinton’s team has actively looked for ways to avoid the traps that have sunk President Barack Obama‘s bid for an immigration overhaul in 2013. Sweeping legislation that included a path to citizenship for millions of people illegally in the U.S. passed the Senate that year, but Republican leaders in the House refused to put the measure up for a vote. Advocacy groups have discussed with Clinton aides the prospect of pushing the House to act on immigration first this time around, testing the will of a chamber that is expected to stay in Republican hands. However, that approach is largely contingent on Paul Ryan remaining speaker of the House. The Wisconsin lawmaker has spoken favorably of the need to address the nation’s fractured immigration laws. But he may face an internal revolt that forces him out of his leadership post, given the anger among some House Republicans over his lukewarm support for Trump during the general election. Asked whether Ryan would be willing to work with Clinton on immigration legislation, spokeswoman AshLee Strong said: “Speaker Ryan is focused on beating Democrats in November, including Hillary Clinton.” In another break from Obama’s immigration strategy, Clinton aides have signaled plans to wield the threat of executive action more aggressively during the legislative process. Obama spent years insisting only Congress could change immigration laws, though he later took executive actions to keep millions of people in the U.S. illegally from deportation. “We’re long past time when a president can simply say, I really supported (immigration reform), but Congress didn’t do it,” said Clarissa Martinez De Castro of the National Council of La Raza, a group that advocates immigration reform. Some of Obama’s executive actions on immigration have been challenged in the courts. The Supreme Court, which is down one justice, deadlocked 4-4 on a decision about the legality of the executive actions. If Clinton is elected, she would presumably nominate a ninth justice inclined to uphold the measures. Beyond the pitched battle potentially ahead on immigration, it’s clear Clinton’s team is looking for ways she could court bipartisan support for other policies. Clinton aides have been telling Democrats that she plans to push swiftly for a package of criminal justice reforms, seizing on an issue with broad Republican backing. She could ask lawmakers to pick up a package of reforms that stalled in the Senate earlier this fall, legislation aimed at reducing mandatory minimum sentences for some non-violent offenders and reducing the money the U.S. spends on incarcerations. “There’s going to be a very important effort for bipartisan cooperation together on this,” Clinton said of criminal justice reform in a radio interview Thursday. Advisers say Clinton does not view gun control, a more politically risky issue even among some Democratic members of Congress, as part of a criminal justice package. Clinton’s other main priority should she win appears to be moving swiftly on a multibillion-dollar infrastructure package aimed at boosting economic growth and creating jobs. She’s proposed spending $275 billion on new road, sewer and other infrastructure projects. Republicans are broadly supportive of infrastructure investments. But as with the numerous fiscal fights between Obama and congressional Republicans, paying for the spending bill could become a point of contention. Clinton’s plan states that “business tax reform” would finance her agenda, which would include $250 billion in direct funding over five years and $25 billion to seed an infrastructure bank. While the details of the tax reforms are unclear, New York Sen. Chuck Schumer has said the money could come from letting companies pay a lower tax rate on their overseas earnings. Hillary Clinton turns focus to down-ballot candidates in final days

Hillary Clinton is expanding her focus in the final days of the presidential race, seeking to help down-ballot congressional candidates. In Pittsburgh on Saturday, Clinton assailed incumbent Republican Sen. Pat Toomey, saying he had failed to “stand up” to Donald Trump in the face of his comments about Mexican immigrants and a Muslim-American military family. She also noted that Trump had “said terrible things about women” and “spread the lie that our first black president wasn’t born in America.” “If he doesn’t have the courage to stand up to Donald Trump after all of this, then can you be sure that he will stand up for you when it counts?” Clinton said of Toomey. Toomey is locked in a tight race with Democratic challenger Katie McGinty. Clinton called McGinty “exactly the kind of senator that Pittsburgh and western Pennsylvania needs. The attacks on Toomey were a new effort from the presidential nominee, who has largely focused her fire on Trump. Clinton did note that some Republicans have had the “grits and the guts” to push back against Trump. Toomey spokesman Ted Kwong said the Clinton comments show how McGinty would not be an independent voice in the Senate. “Today is just further proof that hyper-partisan, ethically challenged Katie McGinty will be a rubber stamp for everything Hillary Clinton wants to do in Washington,” he said. “Pat Toomey has been, and will continue to be, an independent leader in the Senate on issues ranging from gun safety to ending Wall Street bailouts.” Clinton told reporters on her plane in Pittsburgh that she does plan to focus more on helping other Democrats. Koch network refusing to help Donald Trump

From a luxury hotel on the edge of the Rocky Mountains, some of the nation’s most powerful Republican donors are rebelling against Donald Trump. Billionaire industrialist Charles Koch, host of the exclusive weekend retreat, did not mention Trump by name as warned that political leaders are giving “frightening” answers to America’s challenges. One of his chief lieutenants was more direct as he made clear that Koch’s expansive political network would not use its tremendous resources to help Trump win this fall. “We’re focused on the Senate,” said Mark Holden, general counsel and senior vice president of Koch Industries. He noted that none of the presidential candidates are aligned with the Koch network “from a values, and beliefs and policy perspective.” Trump’s dire warnings of growing crime in America, Holden said, simply aren’t accurate. “We’re much safer,” Holden said. “That’s what the data shows.” Koch described the 2016 “political situation” this way: “We don’t really, in some cases, don’t really have good options.” The comments came Saturday, the first of a three-day gathering for donors who promise to give at least $100,000 each year to the various groups backed by the Koch brothers’ Freedom Partners — a network of education, policy and political entities that aim to promote a smaller, less intrusive government. The ambitious Koch network has invested hundreds of millions of dollars to influence politics and public policy over the last decade, but don’t plan to spend anything to help Trump, even if some of the 400 or so deep-pocketed donors gathered in Colorado Springs this weekend think it should. Trump thumbed his nose at the gathering from Twitter. “I turned down a meeting with Charles and David Koch,” the New York billionaire tweeted. “Much better for them to meet with the puppets of politics, they will do much better!” The weekend’s agenda for the estimated 400 donors gathered in Colorado Springs featured a series of policy discussions and appearances from at least three governors, four senators and four members of the House of Representatives, including House Speaker Paul Ryan. Kentucky Gov. Matt Bevin and Arizona Gov. Doug Ducey talked up policy successes in their states on Saturday night, avoiding discussion of the 2016 presidential contest altogether. When it was his turn, Colorado Sen. Cory Gardner touched on the race for the White House, although he did not mention Trump’s name. “Forty years worth of Supreme Court justices are going to be determined this November,” Gardner told donors, a reference to the next president’s ability to fill at least one existing vacancy on the high court. Those yet to appear include Wisconsin Gov. Scott Walker, Texas Sen. John Cornyn, South Carolina Sen. Tim Scott, Utah Sen. Mike Lee, Rep. Mike Pompeo of Kansas. Rep Jason Chaffetz of Utah and Rep. Mike Coffman of Colorado. Koch later told his guests that America’s frustrated electorate is looking at the wrong place — politicians — for answers. “And to me, the answers they’re getting are frightening,” he said without naming any politicians, “because by and large, these answers will make matters worse.” Charles and David Koch have hosted such gatherings of donors and politicians for years, but usually in private. The weekend’s event includes a small number of reporters, including one from The Associated Press. Koch has put the network’s budget at roughly $750 million through the end of 2016. A significant portion was supposed to be directed at electing a Republican to the White House. It will instead go to helping Republican Senate candidates in at least five states: Ohio, Pennsylvania, Nevada, Wisconsin and Florida, Holden said, noting that the network has dedicated $42 million so far to television and digital advertising to benefit Republican Senate candidates. In some cases, the network may try to link Democratic Senate candidates to Clinton, he added, but there are no plans to go after her exclusively in paid advertising. The organization may invest in a handful of races for governor and House of Representatives as well. And while the network will not be a Trump ally, it won’t necessarily be a Trump adversary either. “We have no intention to go after Donald Trump,” Holden said. Supreme Court vacancy is tangible test for 2016 candidates

The presidential election just got real. The unexpected death of Supreme Court Justice Antonin Scalia — and the immediate declaration from Republicans that the next president should nominate his replacement — adds even more weight to the decision voters will make in November’s general election. For months, the candidates have espoused theoretical, sometimes vague, policy proposals. Now, the prospect of President Barack Obama‘s successor nominating a Supreme Court justice immediately after taking office offers a more tangible way for voters to evaluate the contenders. Candidates in both parties moved quickly to reframe the election as a referendum on the high court’s future. “Two branches of government hang in the balance, not just the presidency, but the Supreme Court,” Texas Sen. Ted Cruz said in the latest GOP debate, held in South Carolina just hours after word filtered out Saturday about Scalia’s death in Texas. “If we get this wrong, if we nominate the wrong candidate, the Second Amendment, life, marriage, religious liberty, every one of those hangs in the balance.” Democrat Hillary Clinton painted a similarly stark scenario. “If any of us needed a reminder of just how important it is to take back the United States Senate and hold onto the White House, just look at the Supreme Court,” Clinton said. Clinton has said she would have “a bunch of litmus tests” for potential nominees, including a belief that the Citizens United ruling clearing the way for super political action committees and unlimited campaign contributions should be overturned. She also said the court’s makeup is crucial to preserving abortion rights and the legality of gay marriage nationwide. Bernie Sanders, who is challenging Clinton for the Democratic nomination, has raised opposition to Citizens United as a requirement for any Supreme Court nominees. Scalia, a hero of conservatives during his nearly 30 years on the Supreme Court, was found dead Saturday at a resort ranch in Texas. The court now is divided between four liberal and four typically conservative justices, putting the ideological tilt up for grabs. Obama pledged to nominate a replacement in “due time,” even after Senate Majority Leader Mitch McConnell, R-Ky., said that responsibility should fall to the winner of the 2016 election. Obama could try to ram a nominee through the Senate this year, taking a high court vacancy off the next president’s immediate to-do list. Even if that were to happen, a confirmation vote probably would be months away, leaving the Supreme Court in the center of the campaign during the nomination process. With three other justices over the age of 75, the next president could have other vacancies during his or her tenure, even if Obama fills Scalia’s seat. It’s unclear how the new focus on the Supreme Court might affect voters’ decisions in an election that has seen surprising and unconventional candidates such as Donald Trump and Sanders challenge their parties’ establishments. Previous political thunderbolts that were supposed to push voters toward more traditional candidates, such as last fall’s terrorist attacks in Paris and California, passed without any negative impact on Trump and Sanders. In fact, Sanders has strengthened since then, with the economic-focused Vermont senator handily defeating Clinton in the New Hampshire primary and finishing a close second in the Iowa caucuses. Trying to counter Sanders’ momentum, Clinton has urged voters to consider which candidate is most electable in November. With the balance of the Supreme Court now potentially on the line, Clinton and her allies are certain to increase their warnings about the risk of sending a self-declared democratic socialist to face a Republican in the fall. “For any Democrat thinking about casting a protest vote for Sen. Sanders, this should serve as a wake-up call for what’s exactly at stake,” said Jim Manley, a former aide to top Democratic senators. Among Republicans, Marco Rubio, Jeb Bush and John Kasich are casting themselves as candidates who could appeal to swing voters in the general election and put the GOP in position to guide the next court nominations. But that could open them up to questions from Republican primary voters about the ideological purity of their judicial choices. Cruz is using the potential vacancy to build on his long-standing argument that Republicans should select a nominee with the most conservative credentials. An uncompromising conservative since arriving in the Senate, Cruz vowed to put “principled constitutionalists” on the Supreme Court. He contends Trump could not be trusted to do the same. “Donald Trump is president, he will appoint liberals,” said Cruz, noting the billionaire’s past support for Democratic politicians. Trump was alone among the candidates is naming specific justices he would consider nominating. He singled out Diane Sykes and William Pryor, federal judges appointed by former President George W. Bush. During Saturday’s debate, Kasich bemoaned that Washington and presidential candidates had “run so fast into politics” following Scalia’s death. But if anything, the speed at which politics did take over portends a furious fight to come over which candidate gets to put his or her imprint on the court. Here are five things that happened in Congress this week that you need to know: House Speaker John Boehner announces resignation The 13-term Ohio Congressman who led the Republican party to an impressive House majority in 2010 and again in 2012, announced he’s stepping down as Speaker of the House and will resign from Congress at the end of October. Why it matters? With a possible government shutdown on the line, over Planned Parenthood funding, Boehner was working toward a budget agreement that would avert another government shutdown whilst facing significant pushback from the conservatives in the party who were threatening to unseat him as Speaker if he acted against their wishes. Now, Boehner can simply pass a deal with the help of Democrats to keep the government from shutting down on Sept. 30. McConnell’s cloture dilemma Senate Majority Leader Mitch McConnell has yet again come up short in finding the necessary 60 votes to move forward bills by cloture. Thursday, McConnell’s effort to move a bill that would fund the government through Dec. 11, while redirecting federal funding for Planned Parenthood to other community health providers, failed 47-52. Why it matters: Earlier this month McConnell failed to find the votes to invoke cloture over the President’s Iran nuclear deal, coming up two votes shy of ending debate. With more significant votes on the horizon, McConnell must work even harder to corral the disappointed caucus and move legislation forward in order to prove the success of the new Senate leadership as we prepare to enter a presidential election year. Pope Francis addresses Congress Making history, the pope gave a 50-minute speech to a join session of Congress, where  he touched on several controversial themes of his papacy in front of lawmakers — immigration, the refugee crisis, climate change and the death penalty — calling on the deeply divided Congress to come together and renew a “spirit of fraternity and solidarity, cooperating generously for the common good.” Why it matters: Pope Francis not only became the first-ever pontiff to address a joint-session of Congress, but he also had the ear of both chambers, an honor typically reserved to the President of the United States and other global political leaders. NSA Chief testifies that Hillary Clinton emails were an ‘opportunity’ for foreign spy agencies During a hearing on the NSA, GOP Senator Tom Cotton queried National Security Agency Director Mike Rogers with a series of questions related to Hillary Clinton’s use of a private email server at her home for communications as secretary of state. Why it matters: Once the overwhelming favorite for the Democratic party’s presidential nomination, Hillary Clinton again finds her campaign efforts overshadowed by her decision to use a private email server while Secretary of State. This has left some Democrats to look for an alternative — primarily the undeclared Vice President Joe Biden and Vermont Sen. Bernie Sanders. Senate Democrats offer climate change bill The same week China announced its promise to create the globe’s largest cap-and-trade program in order to help developing countries slash their greenhouse gas emissions, Senate Democratic leaders unveiled their own climate change plan. Their measure that calls for the reduction of greenhouse gas emissions by 2 percent annually through 2025 — a cut even greater than the controversial goal set by the Obama administration. Why it matters: While the bill doesn’t stand a chance of passing with a Republican-controlled Congress, Senate Democrats believe their aggressive climate change efforts will help them win the hearts of countries around the globe, and ultimately American voters who will elect them to take back control of the Senate in 2016.
